These Terms of Service ("Terms") are a binding legal agreement between you ("you," "user") and Southwest CP Investment LLC ("Company," "we," "us," "our"), operator of the Tongues AI application and website (the "App"). By creating an account, accepting these Terms, or using the App, you agree to all of these Terms. If you do not agree, do not use the App.
Please read Sections 12 (Recording Consent), 15 (Disclaimers), 16 (Limitation of Liability), 17 (Indemnification), and 20 (Dispute Resolution & Class-Action Waiver) carefully — they limit our liability and affect your legal rights, including how disputes are resolved.
Tongues AI is an AI-powered voice tool that records, transcribes, translates, and summarizes audio in 90+ languages, and produces documents. The App offers a free tier with daily usage limits and paid Pro plans with expanded use. Features may change, be added, or be removed at any time.
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. If you use the App on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
You must provide a valid name and email to use the App, and you provide your name as an electronic signature when you accept these Terms. You are responsible for the accuracy of your information, for maintaining the confidentiality of your account, and for all activity that occurs under your account.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own lawful purposes. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, scrape, or create derivative works from the App, except as permitted by law.
We offer refunds within 7 days of a purchase if you are not satisfied. After 7 days, payments are non-refundable except where required by law. To request a refund, contact [email protected].
You retain all rights to the audio you record and the transcripts, translations, and documents you create ("Your Content"). You are solely responsible for Your Content and for how you obtain, use, store, and share it. You represent that you have all rights and permissions necessary for Your Content and that it does not violate any law or any third party's rights. We claim no ownership of Your Content and grant you no rights in others' content.
Your recordings, transcripts, folders, and documents are stored on your device. Audio you submit for transcription/translation is processed by our third-party AI provider in transit and is not retained by us after processing. See our Privacy Policy for details.
The App relies on third parties, including Cloudflare (AI processing and hosting) and Stripe (payments). Your use may be subject to their terms and privacy policies. We are not responsible for third-party services, outages, or acts.
You agree NOT to use the App to:
AI transcription, translation, and summaries are automated and may be inaccurate, incomplete, or misleading. The App is not a professional service and does not provide medical, legal, financial, or other professional advice. You are responsible for reviewing and verifying any output before relying on or acting on it.
The App can record audio. You are solely responsible for complying with all laws that apply to you regarding recording, wiretapping, eavesdropping, consent, and privacy, including obtaining the consent of every person you record where such consent is required (for example, "all-party" / "two-party" consent jurisdictions). You represent that you will not use the App to record any person or conversation unlawfully. The Company is not responsible for, and you release it from, any claim arising from your recording of others.
NO HIPAA OR PROFESSIONAL-COMPLIANCE CERTIFICATION. The App is a general-purpose consumer productivity tool. It is NOT HIPAA compliant: the Company is not a HIPAA "covered entity" or "business associate," does not sign Business Associate Agreements (BAAs), and no BAA exists with the third-party AI provider that processes audio and text. The App likewise is not certified or warranted for attorney–client privilege, work-product protection, or any other professional confidentiality standard (legal, medical, therapeutic, financial, or otherwise). While your saved recordings and transcripts are stored on your device, audio and text are transmitted to and processed by a third-party cloud AI provider to produce transcriptions, translations, and AI outputs — processing does not occur solely on your device. If you are a physician, attorney, therapist, or other professional subject to confidentiality, privilege, or data-protection obligations (including HIPAA), you use the App entirely at your own discretion and risk: you are solely responsible for determining whether your use is permitted, for obtaining any required patient or client consent, and for any consequences of recording or processing protected health information, privileged communications, or other regulated information through the App. The Company expressly disclaims all liability arising from such use.
The Tongues AI name, logo, software, and content are owned by the Company and protected by law. Except for the limited license in Section 4, no rights are granted to you. You may not use our marks without written permission.
You use the App voluntarily and at your own risk, and you assume all risk arising from your use of the App and from your reliance on any output.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, secure, error-free, or that output will be accurate.
The App's Live Voice Translate feature produces AI-generated voice translations, provided for convenience only. Like all AI output, it may contain errors, omissions, or mistranslations, and spoken audio depends on voices available on your device — where none is available, only text is shown. If you are a paid subscriber and select a premium AI voice, the translated text is sent to a third-party voice provider (ElevenLabs) to generate the spoken audio; the generated audio may be cached on that provider's or our servers for a limited period (currently up to 30 days), keyed only by a hash of the text content and without your name, email, or other identity attached. The App and the Company are not a certified interpreter or a certified translation service, and Live Voice Translate output does not meet the standard of a professional human interpreter. Do not rely on Live Voice Translate for medical, legal, financial, immigration, emergency, or other high-stakes communications — use a qualified human interpreter for those situations instead. You are solely responsible for verifying the accuracy of any translation before acting on it. All disclaimers, limitations of liability, and the NO HIPAA / no-privilege acknowledgment in these Terms (including Sections 12 and 15–17) apply fully to Live Voice Translate and all other AI features of the App.
The App's document scanning feature uses AI to extract text from a photographed or uploaded document and generate a plain-language explanation, provided for convenience and understanding only. Like all AI output, it may contain errors or omissions — especially with small print, handwriting, or damaged/blurry images. This feature is not legal, medical, tax, or immigration advice, and its output is not a certified translation for official or legal submission. You must verify important details against the original document and consult a qualified professional before acting on high-stakes decisions. Uploaded document images are processed by the Company's cloud AI provider to generate the extraction and explanation and are not stored on our servers. All other disclaimers and limitations in these Terms (including Sections 12 and 15–17) apply fully to the document scanning feature.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, the Company and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the App. Our total aggregate liability for any claim shall not exceed the greater of (a) the amount you paid us in the three (3) months before the claim, or (b) US $50.
You agree to indemnify, defend, and hold harmless Southwest CP Investment LLC and its owners, officers, employees, and affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party, including recording, privacy, or consent laws; or (d) Your Content.
We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or for any lawful reason. You may stop using the App at any time. Sections that by their nature should survive (including 7, 11–20) survive termination.
We may modify the App or these Terms at any time. If we make material changes, we will update the "Last updated" date. Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the App.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute shall be resolved exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction; however, either party may first attempt to resolve a dispute informally by contacting the other. To the extent permitted by law, you and the Company agree that any dispute will be brought only in an individual capacity, and you waive any right to participate in a class, collective, or representative action.
These Terms, together with the Privacy Policy, are the entire agreement between you and the Company regarding the App and supersede prior agreements. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. There are no third-party beneficiaries.
When you accept these Terms, you provide your name as an electronic signature, and we keep a timestamped record of your acceptance (including the Terms version and technical information such as your IP address) as evidence of your agreement.
